Sweepstakes Period: The automotiveMastermind® Sweepstakes (the “Sweepstakes”) will begin on December 1, 2022 and end at 2:30 P.M. Central Standard Time (“CST”) on January 29, 2023 (“Sweepstakes Period”). 

Eligibility: Open only to legal residents of the 50 United States and District of Columbia who work in the automotive industry as an employee of a dealership or an Original Equipment Manufacturer (“OEM”) employee, and as of date of entry, are 18 years of age or older (collectively, “Entrants”). Employees of automotiveMastermind® Inc. (“Sponsor”), other dealers, Convention vendors/exhibitors and any of their affiliates, parent companies, subsidiaries, distributors, suppliers, prize providers, and advertising and Sweepstakes agencies associated with the Sweepstakes (collectively, “Sweepstakes Entities”) and members of their immediate family members (spouses, parents, children, and siblings and their spouses), and/or those living in the same household of each such employees are not eligible. Void outside of the USA, in Puerto Rico, the US Virgin Islands, and other United States territories and possessions. Subject to all applicable federal, state, and local laws, ordinances and regulations. By participating in the Sweepstakes, Entrants accept and agree to be bound by these Official Rules.

How to Enter: At the Convention: During the Sweepstakes Period, Entrants present at the Convention can scan their Convention badge at the Sponsor’s booth located at 1015 or take a demo (“Sponsor-hosted Booth”) to receive one (1) entry (“Scan Entry” or “Entry”) into the Sweepstakes. Limit one (1) Scan Entry per Entrant during the Sweepstakes Period.

Limit one (1) Entry per Entrant during the Sweepstakes Period regardless of method of Entry or combination of methods of Entry. Only an Entrant who is deemed the winner will be contacted.

Random Drawing: There will be two (2) random drawings on Saturday January 28,2023 to select the winners from among all eligible Entries received. Drawing will be conducted by automotiveMastermind® Inc. (“Administrator”), whose decisions are final on all matters relating to this Sweepstakes. Odds of winning are dependent upon the number of eligible Entries received.

Prize is nontransferable, non-assignable, and no substitution is allowed except at Sponsors discretion. A 1099 tax statement will be filed with the IRS for the total value of the prize. The winner (or parent/legal guardian for any Entrant who is a minor in his/her state of residence) will receive a 1099 form in the mail, to be processed in the year in which he or she receives the prize.

Prize Does Not Include Travel, Accommodation and Other Charges: All expenses and incidental travel costs not expressly stated in the Prize Package description above, including but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facilities charges, personal charges at lodging, security fees, taxes or other expenses are the sole responsibility of the Winner.

General Rules: The potential winner (or parent/legal guardian for any Entrant who is a minor in his/her state of residence) will be contacted via phone or email and will be required to complete and return via email/mail, a Declaration of Compliance, liability/publicity release, where permitted by law within five (5) days of notification attempt (including weekends and/or holidays) or prize will be forfeited. Return of prize notification as undeliverable will result in disqualification and forfeiture of prize and an alternate may be selected.

Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. Winners will be contacted with additional details including prize dates. No cash or other prize substitution permitted except at Sponsor’s discretion. The prize is nontransferable.

Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, including but not limited to tampering, unauthorized intervention, fraud or other technical problem, security or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes or the Convention, as determined by Sponsor in its sole discretion or if any portion of the Convention or the Sweepstakes is cancelled, and in the event of cancellation, the potential winner will be selected from among all eligible Entries received prior to cancellation. If the Convention is cancelled prior to any Entries being received, prize will not be awarded. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR ONILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRTY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPOSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST SUCH PERSON TO THE FULLEST EXENT PERMITTED BY LAW. A sponsor reserves the right at its sole discretion to disqualify any individual it finds: to be attempting to tamper with or undermine the Sweepstakes and/or the legitimate operation of the Sweepstakes; to violate these Official Rules; or, to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.

Warranties and Representations; Release of Liability: Entrants (or parent/legal guardian for any Entrant who is a minor in his/her state of residence) (i) release and hold harmless Sponsor, Sweepstakes Entities and each of their parent companies, affiliates, subsidiaries, legal advisors, advertising and Sweepstakes agencies, and their respective officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from any and all losses, damages, rights, claims, and actions of any kind in connection with or participation in the Sweepstakes or resulting from acceptance, possession, or use of any prize, including, without limitation, personal injuries, death or property damage, and claims based on publicity rights, defamation, or invasion of privacy; and (ii) consent to the use by Sponsor and its designees of their names, addresses, likeness and/or any statements for advertising and Sweepstakes purposes in any and all media now or hereafter known, without additional compensation, notification or permission, except where prohibited by law. Released Parties are not responsible for any late, lost, incomplete, stolen, undelivered, misdirected entries or for any computer, technical, printing, typographical, human or other error, including, without limitation, errors by any of the equipment or programming associated with or utilized in the Sweepstakes or which may occur in the printing, the offering or announcing of prize, administration of the Sweepstakes or the processing of Sweepstakes Entries of any kind relating to or in connection with this Sweepstakes. Sponsor is not responsible for typographical or any other error in printing of the Sweepstakes materials or administration of the Sweepstakes or announcement of the prize. If there are any discrepancies between printed materials and the Official Rules, the Official Rules will govern and control.

Disputes: Entrants/winner (or parent/legal guardian for any Entrant who is a minor in his/her state of residence) agree: (a) to release Released Parties, from any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or the prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in the state of New York; Entrants/winner (or parent/legal guardian for any Entrant who is a minor in his/her state of residence) submit to sole and exclusive personal jurisdiction to said courts in the state of New York for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees or court costs; (c) under no circumstances will Entrants/winner (or parent/legal guardian for any Entrant who is a minor in his/her state of residence) be permitted to obtain awards for and Entrants/winner hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and (d) to comply with all the rules. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants/winner (or parent/legal guardian for any Entrant who is a minor in his/her state of residence) or the Sweepstakes Entities in connection with this Sweepstakes shall be governed by, and construed in accordance with, the laws of the state of New York, without giving effect to any choice of law or conflict of law rules of provisions (whether of the state of New York, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New York. All Entrants (or parent/legal guardian for any Entrant who is a minor in his/her state of residence) consent to the jurisdiction and venue of the courts located in New York. In the event of any conflict with any Sweepstakes details contained in these Official Rules and Sweepstakes details contained in any Sweepstakes material (including but not limited to point of sale, television, and print advertising, promotional packaging, and other promotional media), the details of the Sweepstakes as set forth in these Official Rules shall prevail. The Official Rules govern over all other communications. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms and if the invalid or illegal provision were not contained herein.

Data Collection: Sponsor collects personal information from Entrants when they enter the Sweepstakes (and for when they may be deemed the winner of the Sweepstakes). The information collected is subject to the Sponsor’s Privacy Policy located at www.automotivemastermind.com/privacy-policy.
