PRIVACY POLICY (PUBLIC)

automotiveMastermind Inc. (“aM”) is a software as a service digital marketing company that provides, among other things, an online platform for predicting consumer purchasing behavior for marketing and advertising purposes. The full range of aM’s services (the “Services”) shall be as defined in aM’s Terms of Service (Public) or at such other web address as may be notified to User from time to time.
The Terms of Service (Public) are subject to change from time to time, as described in more detail in the Terms of Service (Public). Any terms capitalized but not defined herein shall have the meanings ascribed to them elsewhere in the Terms of Service (Public).
aM provides this Privacy Policy to inform you (the “User”) of aM’s policies and procedures related to the collection, use and disclosure of information aM receives from them. This Privacy Policy may be updated from time to time. Users are advised to consult this Privacy Policy regularly for any changes.
As used in this Privacy Policy, the terms “using” and “processing” information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within aM’s organization or among its affiliates within the United States or internationally.
INFORMATION COLLECTION AND USE
aM’s primary goals in collecting information are to provide and improve the Services to administer User’s use thereof and to enable users to enjoy and easily navigate the Services.
PERSONALLY IDENTIFIABLE INFORMATION
In the course of User’s use of the Services, aM may ask for and may receive personally identifiable information from the User. This refers to information about User that can be used to contact or identify User (“Personal Information”). Personal Information includes, but is not limited to, User’s name, email address, postal address and telephone number and billing information.
aM may also collect other information that User provides as part of User’s use of the Services (e.g., without limitation, zip code and individual preferences) (“Non-Identifying Information”).
aM uses User’s Personal Information (in some cases, in conjunction with User’s Non-Identifying Information) mainly to provide the Services, complete and process User’s reservations, if applicable, and administer User’s inquiries.
Certain Non-Identifying Information would be considered a part of User’s Personal Information if it were combined with other identifiers (for example, combining User’s zip code with User’s street address) in a way that enables User to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, User’s viewing preferences). aM may combine User’s Personal Information with Non-Identifying Information and aggregate it with information collected from other Users to attempt to provide User with a better experience, to improve the quality and value of the Services and to analyze and understand how the Services are used. aM may also use the combined information without aggregating it to serve User specifically, for instance to deliver a product to User according to User’s preferences or restrictions.
aM also uses User’s Personal Information to contact User with newsletters, marketing or promotional materials and other information that may be of interest to User. If User decides at any time that User no longer wishes to receive such communications from us, User should follow the unsubscribe instructions provided in any of the communications (See “Changing or Deleting Information,” below).
When User visits the Services, aM’s servers automatically record information that User’s browser sends (“Log Data”). This Log Data may include information such as User’s computer’s Internet Protocol (“IP”) address, browser type or the webpage User was visiting before User came to the Services, pages of the Site that User visits, the time spent on those pages, information User searches for on the Site, access times and dates, and other statistics. aM does not treat Log Data as Personal Information or use it in association with other Personal Information, though aM may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.
COOKIES
Like many websites, aM uses “cookies” to collect information. A cookie is a small data file that we transfer to User’s computer’s hard disk for record-keeping purposes. aM uses cookies for two purposes. First, aM utilizes persistent cookies to save User’s login information for future logins to the Services. Second, aM utilizes session ID cookies to enable certain features of the Services, to better understand how User interacts with the Services and to monitor aggregate usage by Users and web traffic routing on the Services. Unlike persistent cookies, session cookies are deleted from User’s computer when User logs off from the Services and then closes User’s browser. User can instruct User’s browser, by changing its options, to stop accepting cookies or to prompt User before accepting a cookie from the websites User visits. If User does not accept cookies, however, User may not be able to use all portions of the Services.
PHISHING
Identity theft and the practice currently known as “phishing” are of great concern to aM. Safeguarding information to help protect User from identity theft is a top priority. aM does not and will not, at any time, request User’s credit card information, User’s login information, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. AGGREGATE INFORMATION AND NON-IDENTIFYING INFORMATION.
aM may share aggregated information that does not include Personal Information and aM may otherwise disclose Non-Identifying Information and Log Data with third parties for industry analysis, demographic profiling and other purposes. Any aggregated information shared in these contexts will not contain User’s Personal Information.
SERVICE PROVIDERS
aM may employ certain third party companies and individuals (“Data Partners”) to facilitate the Services, provide the Services on aM’s behalf, perform Services-related assistance or assist in analyzing how the Services are used. User acknowledges and agrees that aM may disclose data it collects through or in connection with the Services to its Data Partners. The collection and use of such information by Data Partners is subject to the Data Partners’ respective privacy policies and terms of use.
COMPLIANCE WITH LAWS AND LAW ENFORCEMENT
aM cooperates with government and law enforcement officials and private parties to enforce and comply with the law. aM will disclose any information about User to government or law enforcement officials or private parties as aM, in its sole discretion, believes necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of us or a third party, to protect the safety of the public or any person, or to prevent or stop activity aM may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity.
BUSINESS TRANSFERS
aM may sell, transfer or otherwise share some or all of its assets, including User’s Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.
CHANGING OR DELETING USER’S INFORMATION
All Users may review, update, correct or delete the Personal Information provided in the course of using the Services by contacting aM. If User would like aM to delete User’s account in its system, User should contact aM at help@am-home-wordpress.automotivemastermind.com with a request that aM delete User’s Personal Information from its database. aM will use commercially reasonable efforts to honor User’s request. aM may retain an archived copy of User’s records as required by law or for legitimate business purposes.
SECURITY
aM is very concerned with safeguarding User’s information. The security of User’s personal information is important to aM. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. When User enters sensitive information (such as credit card number) on aM’s reservation forms, aM encrypts that information using secure socket layer technology (SSL). In some cases, aM also encrypts sensitive information where it is stored on its systems.
aM will make any legally required disclosures of any breach of the security, confidentiality, or integrity of User’s unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to User via email or conspicuous posting on the Services in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
LINKS TO OTHER SITES
aM’s Services contain links to other websites. If User chooses to visit a third party link, User will be directed to that third party’s website. The fact that we link to a website is not an endorsement, authorization or representation of aM’s affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. aM does not exercise control over third party websites. These other websites may place their own cookies or other files on User’s computer, collect data or solicit personal information from User. Other sites follow different rules regarding the use or disclosure of the personal information User submits to them. aM encourages User to read the privacy policies or statements of the other websites User visits.
OUR POLICY TOWARD CHILDREN
The Services are not directed to persons under 18. aM does not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact aM at info@am-home-wordpress.automotivemastermind.com. If aM becomes aware that a child under 13 has provided it with Personal Information, aM will delete such information from its files.
